CRZ dilution paves the way for the affluent in Mumbai to expand their seaside homes

The dilution of Coastal Regulation Zone (CRZ) in 2019 has allowed for more construction near Mumbai's coast, benefiting prominent personalities like Sachin Tendulkar, Jaya Bachchan, and Cyril Shroff. The Maharashtra Coastal Zone Management Authority has approved proposals to add extra floors to existing bungalows and expand luxury residential buildings. However, environmental activists have raised concerns about increasing the load on the coastline and not submitting to the spirit and purpose of the CRZ notification.

In 2019, the stringent Coastal Regulation Zone (CRZ) was diluted, allowing for more construction near the coast. This has benefited some of Mumbai's most prominent personalities, who own prime properties near the sea. The Maharashtra Coastal Zone Management Authority (MCZMA) has recently approved several proposals seeking permission to add extra floors on existing bungalow plots.

One of the properties benefiting from the new rules is the home of cricket legend Sachin Tendulkar and his wife Anjali. They have submitted a proposal to add extra floors to their bungalow near the Carter Road sea face. Currently, the bungalow has an upper basement, lower basement for car parking, ground plus three floors, and a part fourth floor for residential use. The Tendulkars have been given approval to build the entire fourth floor and a full fifth floor by paying a premium to the authorities to utilize the extra Floor Space Index (FSI) and Transfer of Development Rights (TDR). FSI is the ratio of buildable area in relation to the size of the plot.

Another proposal was submitted by actor Jaya Bachchan for additions and alterations to an existing building in Kapol society, Juhu Vile Parle. The plot was approved in 1984 with a basement, ground, and two upper floors. The new proposal is to build the entire second floor, which is currently only partly built, and an additional floor for residential use.

 

The third proposal was submitted by builder Kailash Agarwal for his luxury residential building called Nishika Terraces. The developer has sought permission to expand the building horizontally and vertically at the rear side by proposing residential flats. The new building will have 18 upper floors.

Roopam, the Worli Seaface property of Cyril Shroff, managing partner of the law firm Cyril Amarchand Mangaldas, will also be expanded taking advantage of the new rules. Shroff plans to add another floor on the existing ground-plus-three storey building. The proposal also includes another building at the rear of the existing building.

Experts believe the 2019 CRZ notification, along with the coastal zone management plan of 2021, will allow huge developments near coastal areas in Greater Mumbai. The dilution of the CRZ has allowed more construction on plots falling in CRZ II. The base FSI was earlier restricted to just 1, but now it varies from 2.2 to 4 plus 35% fungible FSI, depending on the road width and the scheme. Environmental activists on the other hand are concerned. Many believe that the modifications to the existing CRZ norms must be looked at more holistically rather than something that only the affluent can benefit from. 

In conclusion, the dilution of the CRZ has allowed for more construction near the coast, benefiting some of Mumbai's most prominent personalities. However, environmental activists have expressed concerns about the potential impact of such developments on the coastline. The authorities need to ensure that the spirit and purpose of the CRZ notification are followed to protect the coastline from exploitation.
