Haryana cabinet approves 'issue resolution scheme' for defaulting colonisers

The Haryana cabinet recently approved a one-time settlement scheme called 'Vivadon Ka Samadhan' aimed at assisting colonizers who have defaulted on arrears of license and renewal fees. The scheme will be valid for six months from its notification. As of April 1, 2022, there are 756 cases where licenses need to be renewed, with outstanding dues of Rs 3,660 crore, of which the principal amount of renewal fee is Rs 1,604 crore and the interest component is Rs 2,056 crore. In order to protect the interest of allottees, the 'Vivadon Ka Samadhan' scheme has been introduced.

The policy has been formulated on the pattern of the EDC relief policy 'Samadhan Se Vikas.' If a colonizer chooses this scheme, then 100% deposit of the principal amount on account of license renewal fee shall be pre-requisite being a statutory charge. If a colonizer deposits 100% of the outstanding principal amount against renewal fees and 25% of the principal amount of license renewal fee on account of interest (i.e., overall, 125% of outstanding renewal fees), the license will be considered for renewal. If a colonizer deposits 100% of the outstanding principal amount against renewal fees and 10% of the principal amount on account of interest, the license will also be considered for renewal.

The cabinet has also approved a policy for phasing in licensed colonies and seeking 2/3rd consent from the allottees for the revision of layout plans and building plans. The policy aims to streamline the issues and processes with reference to the requirement of inviting objections, suggestions, and consent of allottees in cases involving amendment of layout and building plans. The policy aims to resolve many disputes arising out of existing licenses vis-à-vis revision of layouts as well.

Furthermore, the cabinet has given the go-ahead to an amendment regarding the Policy for Planned Development of Low-Density Eco-Friendly Colonies through the grant of a license under Act No. 8 of 1975. To increase the interest of stakeholders, the norms/parameters of the policy will be revisited. After detailed deliberation at various levels, the various amendments such as location parameters, area and approach norms, applicable fees & charges, etc., are proposed to be amended.

In conclusion, the Haryana government's recent approvals of the 'Vivadon Ka Samadhan' scheme, policy for phasing in licensed colonies, and amendment regarding the Policy for Planned Development of Low-Density Eco-Friendly Colonies are all commendable. These initiatives will help to address various issues related to license renewal, layout and building plan revisions, and eco-friendly development. By taking such measures, the Haryana government is committed to promoting sustainable development and providing a conducive environment for colonizers to thrive.
