The Department of Town and Country Planning (DTCP) has issued a show-cause notice to the Residents' Welfare
Association (RWA) of Raheja Atlantis in Gurugram's Sector 31 for unauthorized construction of shops in common
areas. The notice, issued by District Town Planner Manish Yadav, states that the construction of a grocery shop, salon,
coffee shop, and pharmacy in the society is in violation of Section 3B of the Haryana Development and Regulation of
Urban Areas Act, 1975.
According to the section, no person is allowed to construct or reconstruct buildings in a colony except in accordance
with approved plans and subject to specified restrictions and conditions. The RWA president, PP Singhal, has been
directed to remove the structures and provide the approved building plan to the DTCP office by May 15 to avoid legal
action.
The residents of Raheja Atlantis have expressed their concerns over the unauthorized constructions, stating that these
buildings have encroached upon the parking area and obstructed the movement of wind and light. They also allege that
the electricity connections provided to these shops are being counted as residential usage, despite the need for
commercial usage meters. Singhal, in response, has claimed that the temporary structures were built to cater to the
daily needs of senior citizens and that the guidelines will be followed if the department raises objections.
The notice serves as a reminder of the importance of adhering to building regulations and obtaining the necessary
approvals for construction projects. The DTCP's action aims to rectify the unauthorized constructions and ensure
compliance with the approved plans to maintain the integrity and safety of the society. It also highlights the
responsibility of RWAs and developers in upholding the laws and regulations governing the real estate sector to
protect the interests of residents and maintain a harmonious living environment.
