The Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has made assets valued at over INR 570 crore dispute-free between February 2019 and December 2023 through its conciliation forum.
During this period, the authority resolved over 73% of the complaints received through conciliation. In total, around 1,930 complaints were referred to the conciliation forum and over 1,400 cases were settled amicably through mutual consent. Residential properties accounted for around 70% of the disputes resolved.
UPRERA established the conciliation forum in February 2019 to resolve disputes between buyers and developers before formal arbitration. As per UPRERA's complaint filing procedure, conciliation is the first option presented to the complainant.
Many complaints under the Real Estate (Regulation and Development) Act, 2016 relate to delays such as unavailable property on promised dates, interest calculation for delayed periods, verification and recalculation of charges paid to developers in final demand amounts, determination of parking space, maintenance charges from due dates etc.
In conciliation, each party gets time to explain their perspective, which is analyzed by the RERA conciliator and representatives. Matters are then resolved through consensus accepted by both parties.
Out of a total 1,900 cases, 180 were transferred for hearings while 350 complaints remain pending with the conciliation forum. Officials instituted the forum system to avoid litigation and streamline the process, involving representatives from homebuyers associations and builders associations like CREDAI NCR and CREDAI Western UP.
CREDAI Western UP Secretary Dinesh Gupta said they have successfully resolved most cases in UPRERA conciliation with CREDAI members and RERA officials' help along with homebuyer representatives.
