Maharashtra government considering a proposal to register properties using maps

According to a senior revenue official who spoke to TOI this week, the state government may implement a system of registering properties using maps instead of relying solely on geographical descriptions. This could happen if a committee under the Inspector General of Registration (IGR) recommends it to the government. Last Friday, a GR was issued related to this matter and the committee is expected to provide its recommendations within a month.

Currently, a comprehensive geographical description is necessary for the title document. Officials have stated that if registration with maps is implemented, the property title would become more precise. Several states have already begun utilizing maps for property registration.

A group of nine Individuals, including state settlement commissioner officials, property registration department officials, and collectors, will investigate the feasibility of implementing the use of maps for property registration under Sections 21 and 22 of the Indian Registration Act 1908 and Rule 44(1)(i) of the Maharashtra Registration Rules, 1961. Currently, it is not mandatory to attach maps during registration.

As per the official, the committee will assess how the provisions under Sections 21 and 22 of the Indian Registration Act, which deal with the definition of property during the transfer of title, can be implemented. Currently, property is described based on its relative position to other land parcels, but maps can improve the accuracy of the property title. Additionally, the committee will evaluate the changes that registration officials will need to make to implement these provisions.

Since the maps are not currently available, the committee will have to suggest how to create them and how attaching maps will enhance the accuracy of property titles. Officials stated that the Karnataka government has already integrated various sections of the revenue department, including land measurement, maps, registration, and mutation entries, and Maharashtra is examining this model closely.
