Maharashtra government introduces a mobile app for conveyance deed

Members of the State Housing Federation, with assistance from the Cooperation Department, have introduced a mobile phone application to assist housing societies in understanding the process of performing conveyance deed or deemed conveyance. Conveyance deed or deemed conveyance refers to the transfer of land from the builder’s name to the housing society’s name. According to state officials, out of the 1.15 lakh registered cooperative housing societies in Maharashtra, more than 60,000 still need to perform conveyance deed or deemed conveyance. The ‘Housing Co-op Master’ app is available for free download from the Google Play Store, according to the members.

According to a report in TOI, Shree Prasad Parab, who is an expert director and member of the Maharashtra State Cooperative Housing Federation, mentioned that the app incorporates details about society bylaws as well. Parab also stated that increased awareness regarding conveyance or deemed conveyance can aid more housing societies in completing the process and getting in touch with the department in case of any doubts.

The Maharashtra State Cooperative Housing Federation has initiated a series of free lectures about transferring land in the name of housing societies. The videos available on the app provide information on topics related to deemed conveyance, including its process, mutation entries, and others. The general laws included in the app can also assist in resolving disputes among society members concerning maintenance charges and interest on defaults, which experts believes will help reduce such conflicts.

Many believe that it is impractical to educate individuals about cooperative housing societies and their governing acts and bylaws in person. Therefore, employing technology to reach a larger audience is a smart move on the government’s part. Despite implementing a special, targeted campaign for the viral document, the state cooperative department received only 101 applications for deemed conveyance from newly registered housing societies in 2022.

Conveyance refers to the right of ownership of the plot and the building on which the structure stands. If the developer refuses to provide it, the competent authority can obtain deemed conveyance. Newly registered housing societies can request deemed conveyance from the cooperative department four months after their registration if the developer refuses to conduct the deed.

According to sources, only about 2,500 to 3,000 societies are usually registered each year. The deputy registrars have been instructed to contact each society individually to encourage them to apply for deemed conveyance. Members of the state housing federation have also been enlisted to raise awareness among societies.

According to a deputy registrar, they have been following up with some societies, but many are reluctant to pursue deemed conveyance because builders have not delivered the promised facilities. They say builders frequently delay the process by not providing the necessary amenities they had promised and failing to provide details of the maintenance fees collected for the project.
