In a significant development in Bengaluru's Jigani region, a private builder found themselves at the centre of a legal web as the police have served them with a legal notice following a criminal complaint concerning the purported encroachment of Hennagara Lake in the Bengaluru Urban district. The legal action was triggered by a complaint filed on December 10 by Rajesh, the Chief Executive Officer of Jigani City Municipal Council, invoked multiple legal provisions.
Notably, the builder is accused of violating the Karnataka Land Revenue (Amendment) Act-2007, in addition to facing charges under sections of the Indian Penal Code, specifically IPC 447 (Punishment for criminal trespass) and IPC 427 (Mischief causing damage to the amount of Rs 50). The gravity of the allegations is underscored by the registration of a First Information Report (FIR) against the builder.
Law enforcement officials have confirmed the issuance of a notice to the management of the implicated private builder. The notice mandates the builder's representatives to present themselves before the authorities promptly. The complaint identifies the land in 32 survey numbers as encroached by the accused firm. Besides measuring the alleged encroachment, the police would inspect records of the said land from the CEO of Jigani City Municipal Council.
The crux of the matter revolves around allegations that the builder, over a span of weeks, engaged in unauthorized activities around Hennagara Lake. Observers reported trucks dumping soil and other materials in and around the lakebed, prompting the intervention. Rajesh's official complaint asserts that the firm commenced encroachment on Hennagara Lake without securing requisite permissions, setting the stage for a thorough investigation.
As authorities delve into the intricacies of the case, the onus now rests on the municipal council to furnish essential documents that would expedite the investigative process.
