In a recent development, the Supreme Court has issued an interim order compelling real estate developer Mantri Castles Private Ltd, now known as Castles Vista Pvt Ltd or Mantri Developers, to promptly hand over possession of the long-delayed Mantri Serenity project to 48 homebuyers in Bengaluru. Despite making either full or nearly full payments, the buyers faced protracted delays, prompting legal action. The court's order, dated November 7, emphasizes strict adherence to the agreement terms, directing the delivery of the concerned flats within one week. The exercise is mandated to conclude before the upcoming hearing on February 14. Advocate Bishwajit Bhattacharyya is representing the 48 homebuyers in this case, with instructions from advocate Chandrachur Bhattacharyya. The legal proceedings reveal a tortuous journey for the homebuyers who, after the developer failed to meet the promised delivery date, approached the National Consumer Disputes Redressal Commission (NCDRC). Disappointingly, the NCDRC disposed of the case, prompting the 48 buyers, who had booked flats between 2013 and onwards for amounts ranging from Rs 75-95 lakh, to appeal before the Supreme Court. The homebuyers involved in the case, preferring anonymity due to its ongoing legal status, allege that while the developer has fulfilled its commitments to other buyers, it has yet to deliver on its promises to these 48 families. The homebuyers are still awaiting communication from the developer regarding possession. This legal saga underscores the challenges faced by homebuyers in securing their properties, even after resorting to legal remedies. The Supreme Court's intervention seeks to ensure that the agreed-upon possession of properties is fulfilled promptly, bringing a measure of resolution to the protracted plight of these 48 families.
