In a significant development, plot owners who have lost portions of their land due to errors or oversights in Ahmedabad Municipal Corporation's (AMC) town planning schemes can now anticipate some relief. The civic body is poised to offer compensation to these landowners in the form of Transferable Development Rights-Floor Space Index (TDR-FSI). This initiative will grant landowners TDR certificates, which can then be sold to developers working on projects within their designated areas. The proposal is currently awaiting approval.
The initial beneficiaries of this decision will be a group of plot owners within Naranpura Town Planning Scheme 29. They will be compensated with TDR valued at ?3.35 crore for receiving a smaller area than initially allocated in their final plots. This comes as a long-awaited reprieve for these plot owners, who have been embroiled in a 25-year battle with AMC.
The issue traces back to 1973 when the Gujarat Housing Board (GHB) acquired 4,507 sq m of land in revenue survey number 292. However, AMC erroneously allocated a smaller area to the landowners, deviating from the expected 60% of the final plot size. The error occurred when the town planning officer (TPO) responsible for survey number 292 deducted 60% from 6,818 sq m, instead of the accurate 8,544 sq m indicated in the 7/12 revenue document, which includes vital information like survey number, landowner details, type, and size.
Ketulkumar Patel and other affected landowners had been petitioning for a resolution since March 12, 1996, making submissions to AMC on June 2, 2014, and again on March 19, 2019, in an effort to rectify the situation. Regrettably, the TPO failed to respond to their pleas. Patel, for instance, found himself in possession of 1,036 sq m less than the actual final plot size. To compound matters, a section of the petitioners' land was acquired for the upcoming Olympic-grade sports complex in Naranpura. Frustrated by the bureaucratic hurdles, Patel eventually requested an allocation of FSI or TDR against the plot he had lost.
A seven-member committee, chaired by the municipal commissioner, was formed to investigate the situation. This committee acknowledged the TPO's error and designated it as a 'departmental error' within the TP department. The AMC has now accepted the committee's recommendation and put forward a proposal to compensate the landowners with a cumulative TDR-FSI valued at ?3.35 crore.
