The Department of Town and Country Planning (DTCP) has issued show-cause notices to 45 residential properties in South City 2, Gurugram, for alleged misuse and violations of the Haryana Urban Development Act, 1975. Following a recent survey conducted by the DTCP's enforcement team, these properties were found to be in violation of various regulations. As a result, the property owners have been served show-cause notices. They are required to file their responses within seven days, failing which the authorities may take further actions, including issuing restoration orders and cancelling occupation certificates.
Manish Yadav, the District Town Planner, provided insights into the situation, explaining that the department allows certain commercial activities in residential colonies, provided they adhere to specific criteria. For instance, these activities can occupy up to 25% or 50 square meters of the total construction area on the ground floor of residential properties. These activities, including offices for property dealers, lawyers, chartered accountants, contractors, clinics, tax consultants, architects, town planners (without studios), company secretaries, ayurvedic and homeopathic practitioners, tourist guides, psychiatry clinics, and more, fall within the "no-nuisance" category.
The enforcement team from the DTCP has been actively conducting sealing and demolition operations in licensed colonies, particularly against illegal commercial activities. To date, more than 200 properties have been sealed due to various building violations and non-compliance with relevant regulations.
The action taken by the DTCP highlights the significance of adhering to zoning and land-use regulations, especially in rapidly growing urban areas like Gurugram. These regulations help maintain the character of residential neighbourhoods, ensure the availability of essential services and infrastructure, and prevent the adverse effects of incompatible land uses.
In light of these developments, property owners and residents should be aware of the importance of following zoning and land-use regulations in their respective localities to avoid potential legal consequences and disruptions to their daily lives.
The recent actions taken by the DTCP in Gurugram serve as a reminder of the importance of compliance with zoning and land-use regulations. These regulations play a vital role in shaping urban environments, preventing conflicts, and supporting sustainable development. Property owners and buyers should be diligent in understanding and adhering to these regulations to avoid legal complications and contribute to the well-being of their communities.
