Aaditya Builders, a real estate development company, is facing legal trouble as the Borivali police have initiated legal proceedings against them for alleged fraudulent activities involving a chartered accountant, Harshit Kadhi. The complaint suggests that despite receiving a full payment of Rs1.1 crore, the builders failed to provide Kadhi with the promised 941 sq ft flat located on the 12th floor of a proposed redevelopment building in Borivali West.
This saga began in January 2018 when a deal for a spacious three-bedroom flat was brokered between Harshit Kadhi and Aaditya Builders. During their initial visit to the builder's office, Kadhi and his father were presented with a comprehensive plan and floor layout of the Vilas Vaibhav Co-op-society's redevelopment project. Everything seemed promising at that point, and Kadhi made the first steps toward securing his new home.
Things took a concerning turn in August of the same year when the father-son duo returned to the builder's office. They were informed that construction had progressed to a point where the full payment was now due. Unfazed, Kadhi agreed to this condition and proceeded to make five transactions to fulfil his financial commitment. Subsequently, a purchase deed was prepared and finalized by September 1, 2020. As an apparent sign of assurance, the builders issued a possession letter on the company's letterhead, seemingly signalling that Kadhi would soon take ownership of his new property.
However, the situation took an unfortunate twist when despite multiple reminders and ongoing requests, the flat remained elusive. In a distressing turn of events this year, in July, the two builders, Himesh Desai and Nisheedh Shah, allegedly resorted to threatening Kadhi with dire consequences if he persisted in his demand for possession of the flat. This was a distressing and unsettling development for Kadhi, who had already invested substantial time, trust, and, most importantly, money into this real estate transaction.
Finally, after facing such prolonged hardship and threats, Kadhi decided to seek legal redress. On October 9, a case was formally registered against the builders. They are accused of breaching trust and engaging in fraudulent activities, as outlined by relevant sections of the Indian Penal Code and the Maharashtra Ownership Flats Act.
As the legal process unfolds, it serves as a stark reminder of the importance of due diligence in real estate transactions, the need for transparency and accountability in the industry, and the significance of promptly addressing disputes to protect the rights and interests of all parties involved. The case against Aaditya Builders underscores the critical role of law enforcement and the legal system in ensuring that individuals and companies are held accountable for their actions, particularly when they involve allegations of fraud and deception.
