EOW, Mumbai Police give clean chit to Pashmina Realty in cheating case

The Economic Offences Wing (EOW) and the Powai police have closed an alleged cheating case against builder Pashmina Realty and its directors. The complaint was filed by Ekta Housing, Pashmina's partner in a joint venture project called Lake River in Powai. Ashok Mohanani, the chairman of Ekta Housing, accused Pashmina and its directors of inducing him to redevelop the property by presenting a false picture and then cheating and defrauding him by extracting huge sums of money and misappropriating funds. As a result, Ekta Housing suffered a loss of Rs 165 crore.

A First Information Report (FIR) was filed by the Juhu police on the directions of the Metropolitan Magistrate Court based on a private complaint made by Mohanani. Ekta Housing then filed a second complaint with the Powai police station against Pashmina Realty. Both the EOW and the Powai police carried out their investigations on November 23, 2022 and December 16, 2022, respectively, and eventually gave a clean chit to Pashmina by filing a detailed closure report.

The police classified the case as a "C summary," meaning that the allegations were of a civil nature and there was no evidence of any criminal behaviour. The closure report stated that Pashmina Realty tried to reach a solution with Ekta Housing through several meetings, conducted with the presence of solicitors from both parties. However, the transactions between the two parties were found to be of a civil nature and there was no evidence of any criminal behaviour.

The conclusion of this case highlights the importance of thorough investigations and the legal process in determining the truth in cases of alleged cheating and fraud. The closure report serves as a reminder that not all disputes can be resolved through criminal charges and that some may be better suited for a civil resolution. It is also a reminder that it is essential to gather all relevant evidence and carefully examine all the facts before making accusations of criminal behaviour.

In this case, the result was a clean chit for Pashmina Realty and its directors, but in other cases, the outcome may be different. The legal process ideally provides a fair and impartial way to determine the truth and serves as a protection for all parties involved.
