In Gurugram, the Vatika India Next residential project in Sector 82 has become the focal point of controversy as allottees raise concerns over unfulfilled promises and administrative issues. The Department of Town and Country Planning (DTCP) has taken action in response to these grievances, issuing a formal notice to the developer, Vatika Group. The notice stipulates that the Managing Director of Vatika Group must provide a response within seven days, or else face potential repercussions.
The crux of the issue lies in the prolonged absence of zoning plans for the plots allocated to buyers more than five years ago. These zoning plans are essential for construction purposes, and their absence has left allottees in a frustrating state of limbo. Without proper zoning plans, they are unable to proceed with their construction plans, stalling their investments and dreams of owning homes in the Vatika India Next project.
Moreover, the allottees have raised other significant concerns regarding their dealings with the developer. One glaring issue is the non-issuance of conveyance deeds for the allotted plots. Conveyance deeds are legal documents that transfer the property's title from the developer to the buyers, essentially confirming their ownership. The absence of these deeds has not only hindered property transactions but also prevented allottees from obtaining loans against their properties, limiting their financial flexibility.
Additionally, the delay in providing occupation certificates (OCs) compounds the problem. OCs are essential documents that certify the safety and compliance of constructed floors within the society. Astonishingly, some of these floors were handed over to allottees approximately a decade ago, yet they still await OCs. This further hampers the resale value of these properties, as they cannot be legally sold without the necessary certifications.
The Senior Citizen Federation of New Gurgaon (SCFNG) has taken up the cause on behalf of these frustrated allottees. They have written to district town planners, seeking action against Vatika Group for these persistent issues. The federation's president, SL Singla, emphasizes that the absence of OCs has a cascading effect, making it impossible to complete conveyance deeds and leading to a situation where neither property sales nor loans can be secured at market prices. This has left allottees in a precarious financial position, with their investments in jeopardy.
Moreover, the allottees have identified the construction of illegal booths in the colony, which have been sold in clear violation of established norms. Financial matters have also come into play, with the builder management allegedly demanding excessive fees from allottees. This includes a demand for Rs 1.18 lakh in the name of mutation/termination, along with additional charges like stamp duty for registration, Rs 50,000 in advocate fees, and GST.
In response to the allottees' complaints, the DTCP's Enforcement division has taken action. According to source, a notice has been formally issued to the Managing Director of Vatika India Ltd seeking a response regarding the allegations raised by the allottees. The developer is expected to provide a comprehensive reply within seven days, as per the stipulated timeline. Failure to do so could result in further actions being taken by the authorities, as dictated by relevant provisions.
