Prominent builder in Nagpur encroaches upon a Playground and Road in Rajiv Nagar and Sita Nagar

In Nagpur, a builder's actions have led to the encroachment of a playground and internal road at Rajiv Nagar and Sita Nagar. This encroachment, done to store construction materials and debris, has resulted in the disruption of sports, fitness, and recreational activities for residents, particularly affecting children and senior citizens. Despite the Nagpur bench of the Bombay High Court issuing a contempt order and noting rule violations, officials from the Nagpur Municipal Corporation (NMC), specifically the Laxmi Nagar zone, are ignoring the situation.

The builder, Praful Deshmukh and Co, acquired plot no. 2 under the NMC's London/Orange City Street scheme and began constructing a commercial complex. The newly concretized road is at the front, while the 54,000 sq ft playground is at the rear.

Residents of Rajiv Nagar and Sita Nagar reported that the builder breached the playground's compound wall at multiple spots, including the entrance gate, to store construction materials and debris for a month. Children have stopped playing due to this encroachment, and senior citizens can no longer engage in fitness activities. Religious activities near the temples on the playground's edge have ceased. The surface of the playground is significantly damaged due to heavy vehicle movement and construction activities.

The Shivshakti Bahuddeshiya Yuva Seva Sanstha used to organize activities for children on the playground, but now fitness and sports programs for 15 children are hampered. The presence of construction materials and debris on the walking track has halted their activities, leading to dust, noise, and other disturbances.

The builder has also stored construction materials along internal roads, leading to road damage and the uprooting of trees. NMC officials stated that the builder had no permission to use the playground. Praful Deshmukh, the builder, mentioned plans for repairing the playground and its compound wall, claiming to have consulted residents. 

The unified development control and promotion regulations prohibit the use of a playground for storing construction materials and debris. Structures like compound walls cannot be demolished unless approved by the NMC general body. In various court orders, it was emphasized that a playground should be accessible to local children for their unrestricted use and recreational purposes. The focus should remain on children's and citizens' recreational activities. 

In conclusion, the issue of encroachment on the playground and internal roads by the builder has raised concerns despite court orders and rule provisions. The disregard for these regulations has impacted the community's recreational spaces and activities.
