The Gujarat High Court has taken a significant step towards addressing the issue of unauthorized constructions in municipalities across the state. In a recent hearing, the court sought detailed information from the relevant authority regarding the status of applications for regularization under the new impact fee law.
The bench, comprising of acting Justice A J Desai and Justice Biren Vaishnav, directed the deputy commissioner of municipalities to submit an additional affidavit disclosing the actions taken on the regularization requests. This move demonstrates the court's commitment to resolving the matter effectively and efficiently.
During the hearing, it was revealed that a staggering number of 13,575 regularization applications have been received by 156 municipalities in Gujarat. This overwhelming response further emphasizes the urgent need to address unauthorized constructions and provide a legal framework for regularization.
Specifically, the court focused on the town of Dholka, where approximately 140 residential and commercial buildings were constructed without proper authorization. The court has instructed the municipality to provide information regarding the status of requests related to the regularization of these unauthorized structures. By doing so, the court aims to gain a comprehensive understanding of the current situation and ensure that appropriate actions are taken.
Among the unauthorized constructions in Dholka, it was disclosed that four builders were responsible for these structures. Encouragingly, two of these builders have already applied for regularization, signalling a willingness to rectify their past actions. The court has urged the authorities to promptly furnish relevant information by August 9, enabling them to make informed decisions and take appropriate actions.
This proactive approach by the Gujarat High Court sets a positive precedent in dealing with unauthorized constructions.
