Gurugram's Mayfield Garden Residents Welfare Association (RWA) is facing legal consequences for unlawfully constructing commercial structures at a dispensary site. The Department of Town and Country Planning (DTCP) has issued a restoration order, following a show-cause notice that was served to the RWA earlier this year.
In January 2023, the district town planner (enforcement) sent a show-cause notice to the Mayfield Garden RWA regarding the illegal construction. However, the RWA has failed to provide a response thus far, prompting the DTCP to take further action.
The restoration order requires the RWA to remove the unauthorized structures within a strict timeframe of seven days. Failure to comply with the order will result in the demolition of the illegal constructions. This decision comes as a result of the RWA's non-compliance and their lack of effort to rectify the violation.
The enforcement wing of the TCP has determined that the Mayfield Garden RWA has erected various commercial establishments, including shops, rooms, salons, property dealers' offices, medical equipment shops, and stores catering to patients, all on the premises designated for a dispensary. These constructions blatantly violate the rules outlined in the Haryana Urban Development Act.
An official from the department stated that the RWA has illegally set up salons, property dealers' offices, medical equipment shops, and stores providing beds to patients, all at the dispensary site in N block.Upon inspection, officials confirmed the veracity of the complaint, leading to the issuance of the restoration order.
Despite being given a seven-day period to respond to the show-cause notice issued in January, the RWA failed to provide a satisfactory reply, leaving the department with no choice but to proceed with the restoration order.
Meanwhile, in addition to taking action against the Mayfield Garden RWA, the TCP has also issued notices to traders engaged in illegal commercial activities and unauthorized construction in violation of regulations in the DLF 2 and 3 areas. The department has warned these traders that if satisfactory responses are not submitted promptly, sealing drives will be conducted to curb further violations.
As the deadline for the restoration order looms over the Mayfield Garden RWA, it remains to be seen whether they will comply with the directive or face the consequences of their actions. The case serves as a reminder of the importance of adhering to legal regulations and obtaining necessary permissions before undertaking construction projects to maintain the integrity of urban development and protect public spaces.
