Goa builder fined Rs 1.26 crore for environmental clearance violation

In Goa, a builder has been fined Rs 1.26 crore by the Goa State Environment Impact Assessment Authority (Goa-SEIAA) for starting construction activities on a project in Taleigao without obtaining the required environmental clearance. The residential-cum-commercial complex comprises four phases, including one located on a hillside. The builder had initiated the project activities without obtaining prior environmental clearance, which is a clear violation of the Environment Impact Assessment Notification 2006 and its amendments.

During the meeting held on May 16, the director of the construction company appeared before the authority, where the Goa-SEIAA noted that the project proponent had admitted to carrying out the project activities without obtaining environmental clearance. The authority found that the total project cost incurred up to the date the builder filed for the application was Rs 126.2 crore, and as per the office memorandum on standard operating procedure for handling of violation cases dated July 7, 2021, 1% of the total project cost must be penalized for violation cases.

Therefore, the Goa-SEIAA imposed a penalty amount of Rs 1.26 crore on the builder. The project proponent was also directed to apply for environmental clearance under the violation category. The environmental clearance process is required for 39 types of projects, as per Union environment ministry notifications, and covers aspects like screening, scoping, and evaluation of the upcoming project. The purpose of the clearance is to assess the impact of the planned project on the environment and people, and to try and minimize any negative impact.
