Civic bodies ask UDH to shelve Rajasthan RERA order on registering schemes

Several civic bodies in Rajasthan, including the Jaipur Development Authority (JDA), have raised objections to a notification issued by the Rajasthan Real Estate Regulatory Authority (RERA) in September 2021. The notification mandates that all civic bodies must register all real estate schemes under RERA. The civic bodies, including JDA, have written to the Urban Development and Housing department (UDH) challenging the notification, arguing that it falls outside their jurisdiction to register schemes under RERA.

An official from the UDH department confirmed that they had received letters from various civic bodies expressing their concerns over the notification. These civic bodies have requested the UDH department to intervene and withdraw the notification, contending that it is not their responsibility to register schemes under RERA. The UDH department acknowledges the concerns raised by the civic bodies and is considering taking up the issue with RERA officials to find a resolution.

The notification, issued on September 27, 2021, stipulates that regardless of whether a housing cooperative society has prepared a plan, or it has been sanctioned by a regulatory body, it becomes the responsibility of the respective civic body to register the scheme under RERA. This implies that all housing projects in the state of Rajasthan must be registered under RERA, and the civic bodies are tasked with ensuring compliance with RERA norms and regulations during the construction process.

Officials from the JDA have argued that assuming the responsibility of registering housing schemes according to RERA instructions would require them to oversee the development work and adhere to all the bylaws and norms of the RERA Act. They assert that this is not feasible for a civic body as they have their own distinct set of laws and bylaws governing their operations.

One particular concern highlighted by a JDA official is the potential impact on the Prashasan Shehron Ka Sang Scheme if the notification is implemented. It is unclear how exactly the scheme would be affected, but the official suggests that the consequences could be significant.

The UDH officials are taking the concerns raised by the civic bodies seriously and have expressed their intent to address the matter with RERA officials. They are actively seeking a solution that can reconcile the differing viewpoints and ensure a balanced approach to the registration of real estate schemes under RERA while considering the limitations and operational dynamics of the civic bodies involved.

In conclusion, the notification issued by RERA in September 2021, making it mandatory for civic bodies to register all real estate schemes under RERA, has faced opposition from several civic bodies in Rajasthan. The UDH department is actively engaging with the civic bodies and exploring ways to resolve the issue in consultation with RERA officials, taking into account the concerns raised and the potential implications for ongoing schemes.
