The State Consumer Disputes Redressal Commission has criticized the lack of police action in a case involving the directors of Arshdeep Buildcon Private Limited in Bilaspur. The commission has now ordered the Director General of Police (DGP) to personally intervene and ensure the execution of the arrest warrant against the directors.
Despite receiving four previous notices, the superintendents of police (SPs) in Bilaspur and Durg districts failed to comply. The commission had issued these notices to facilitate the arrest of realtors Sardul Singh and Raspal Singh, who are required to appear before the consumer court during the upcoming hearing on June 19, 2023.
The commission further noted that the builders reside in Durg while their office is located in Bilaspur. Consequently, show cause notices were issued to both SPs, requiring their personal presence or the representation of their officials at the commission's circuit bench in Bilaspur on June 19, 2023, along with the realtors.
Gautam Chourdiya, the commission president, expressed disappointment with the senior police officers for their failure to comply with the commission's orders since 2019. Chourdiya emphasized that the realtors' whereabouts could have been easily determined.
The case revolves around a complainant from Bilaspur who entered into an agreement with the builders in 2017 for the construction of a G+1 house. The complainant paid Rs 26.50 lakh to the builders in three instalments, with the expectation that the house would be delivered within eight months. However, after the stipulated timeframe passed without any progress in construction, the complainant requested a refund. When the builders refused, the complainant lodged a complaint with the consumer court, which issued notices to the builders. After attending the first hearing, the builders failed to appear for subsequent hearings.
Ultimately, the consumer court ruled in favour of the complainant, but the builders neither challenged the decision at the national commission nor provided the refund. Subsequently, the complainant initiated an execution case in the state consumer court, leading to the issuance of an arrest warrant against the builders. However, the SPs of Bilaspur and Durg districts failed to execute the order despite receiving four notices.
