According to a recently released report by the Pune Cooperation Department, approximately 17,000 registered housing society in the city of Pune do not have conveyance or deemed conveyance. According to officials the main reason for the current situation is incomplete documentation and property disputes. Although the state cooperation department has started various measures to give conveyance deeds, there still there a lot of hindrances in achieving their goal.
Conveyance refers to the transfer of ownership of property from one party to another. In the context of real estate in India, conveyance refers to the legal transfer of ownership of the land and building from the developer or landowner to the cooperative housing society or apartment association.
Deemed conveyance, on the other hand, is a legal provision that allows for the transfer of ownership of a property to the housing society or association in cases where the original owner or developer fails to execute the conveyance deed despite repeated requests from the society.
This provision was introduced to protect the interests of the flat or apartment owners who have invested in the property and have the right to obtain ownership rights. In such cases, the registrar of cooperative societies can issue a deemed conveyance certificate, which acts as proof of ownership for the society or association.
To address the looming problem, sources say that state officials intend to conduct monthly camps which will be held area wise to educate and assist housing societies applying for conveyance or deemed conveyance. Housing society representatives, district registrars and housing federation members will be invited.
The cooperation department has initiated taluka and wise monthly camps to identify housing societies without conveyance or deemed conveyance and speed up the process. It also said that if the need arose camps will be held twice or even thrice a month. At present the state of Maharashtra has over 1 lakh registered housing societies. Of these a little over 72,000 do not have conveyance or land ownership titles.
According to an article published in TOI, the Pune City Deputy District Registrar Sanjay Raut, claims the state department began drives for deemed conveyance back in 2011. Through this drive, up till now, over 3,300 orders have been issued and over 1900 conveyance deeds have been executed. However, many housing societies are yet to receive their conveyance deeds from the property registration department and property cards from the city’s survey office.
Earlier in March this year, an app was launched by the state housing federation members with the help of the cooperation department to guide housing societies about the process. The app also offers videos on related topics such as mutation entries, and more.
Apart from this, social media groups have been formed so that more and more housing societies are aware of deemed conveyance as many societies ignore deemed conveyance. Special dives by state housing federation have been started so that housing societies do not ignore deemed conveyance. The federation also started a free lecture series on the conveying land in the name of housing societies.
