Supreme Court orders two illegal buildings in Navi Mumbai to be razed

In a relief for local activists, the Supreme Court has passed a judgement ordering two illegal buildings constructed in 2011 in Nerul, Navi Mumbai to be brought down. The apex court has given the families residing in these buildings six months to vacate, allowing the NMMC to take necessary action once the time lapses. Individuals who purchased flats in the complex where aware of the legal standing of the buildings. According to Section 56 of the Maharashtra Regional Town Planning Act 1966, the civic and police officials who allowed the construction to take place are also liable to be penalised and the so the Supreme Court has asked for them to be held liable as well. Current Municipal Commissioner Rajesh Narvekar has said he would follow the order and take necessary steps to implement the same.

In 2010, construction began on two plots situated in Section 16A of Nerul, which had been earmarked for the creation of a public garden. Once CIDCO handed over the plots to NMMC, the civic body did little to stop Nilesh Patel, Nilesh Bhagat and Ganesh Bhagat from constructing two residential complexes by the name Krishna Complex and Trimurti Park. CIDCO then issued a notice to the builders, informing NMMC of the same which resulted in an official complaint being logged against all involved under the MRTP Act. The builders moved to the Bombay High Court to seek a stay order on the demolition. Several attempts were made by the builders and flat owners to stall the demolition but in vain.
